INFORMATION FOR EMPLOYEES OF THE DEPARTMENT OF HOMELAND SECURITY

Several years ago Kern Law Firm filed a lawsuit under the Fair Labor Standards Act (FLSA) on behalf of a nationwide group of current and former Canine Enforcement Officers (CEOs) employed by Customs and Border Protection (CBP) of the Department of Homeland Security. The case concerned unpaid off-the-clock work performed by CEOs in connection with various dog training activities. This case was vigorously litigated and proceeded to trial in the Court of Federal Claims in Washington, D.C., where the trial court heard testimony from representative plaintiffs and ruled in their favor. The United States appealed the trial court's decision and the United States Court of Appeals for the Federal Circuit then affirmed that decision in favor of the plaintiffs. The government subsequently settled the case with the nationwide group of CEOs who opted-in to the lawsuit.

More recently Kern Law Firm filed another lawsuit under the FLSA and other federal pay laws on behalf of a nationwide group of current and former employees of CBP for unpaid training time. This case is currently being litigated in the Court of Federal Claims. Several hundred CBP officers joined the lawsuit during the opt-in period and it is now closed to further participation.
